Terms and Conditions
These terms and conditions (the “Terms and Conditions”) govern the use of www.thecheekypeach.ca (the “Site”) and the services provided by The Cheeky Peach, a detox and wellness spa operating within Aura Aesthetics & Wellness, located at 16 Front St S, Thorold, Ontario. The Cheeky Peach is owned and operated by Tiffany Currie.
By using this Site or booking any of our services, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
Services
The Cheeky Peach provides in-person detox and wellness treatments. Our service categories include, but are not limited to:
- Body contouring and skin tightening (pressotherapy, radio frequency, laser lipo, cavitation)
- Laser treatments (hair removal, skin rejuvenation)
- Facial cosmetics (microneedling, LED therapy, dermaplaning)
- Wellness and detox services (infrared sauna, ionic foot detox)
- Teeth whitening
- Lash treatments (lifts, tints, extensions)
All services are provided at our physical location and are subject to availability. Service descriptions, images, and information provided on our Site are as accurate as possible; however, individual results may vary and are not guaranteed.
Wellness Treatment Disclaimer
The treatments and services provided by The Cheeky Peach are non-medical wellness treatments. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition, and are not a substitute for professional medical advice, diagnosis, or treatment.
Client responsibility: It is your responsibility to disclose any medical conditions, medications, allergies, pregnancies, or other health concerns that may affect the safety or suitability of any treatment. You must complete any required intake or consent forms truthfully and completely before receiving services.
Results: Results vary from person to person and are not guaranteed. Before-and-after photos displayed on our Site or in our facility represent individual outcomes and should not be interpreted as a promise of similar results.
Right to refuse service: Our practitioner reserves the right to refuse or discontinue any treatment if, in their professional judgment, contraindications or safety concerns are identified.
Booking & Appointments
Appointments are booked through JaneApp, a third-party scheduling and payment platform. When you book an appointment, you will be directed to JaneApp's platform, which operates under its own Privacy Policy and Terms of Service. Payment for services is collected by JaneApp at the time of booking or at the time of service.
The Cheeky Peach is not responsible for the data collection practices of JaneApp. We encourage you to review their policies before booking.
Cancellation Policy
Your appointment time is reserved just for you. A late cancellation or missed visit leaves a gap in the practitioner's day that could have been filled by another client. We understand that life happens. However, please be respectful of your practitioner's time.
As such, we require 24 hours notice for any cancellations or changes to your appointment. Clients who provide less than 24 hours' notice to cancel their appointment will be charged a $50 cancellation fee.
Clients who no-show to their appointment will be charged 50% of their service fee.
Refunds
Single appointments: Services are non-refundable once rendered. If you are dissatisfied with a treatment, please contact us so we can work with you to find the best solution possible.
Memberships and packages: Membership fees and package purchases are non-refundable, except as required by applicable law, including the Ontario Consumer Protection Act. See the Memberships & Packages section below for cancellation details.

Memberships & Packages
The Cheeky Peach offers monthly memberships and multi-visit packages. By purchasing a membership or package, you agree to the following:
- Billing: Monthly memberships are billed on your anniversary date (the date you enrolled). Payment is collected automatically via your payment method on file.
- No rollover: Unused visits or sessions included in your monthly membership do not roll over to the following month.
- Non-transferable: Memberships and packages are for the named member only and cannot be transferred to another person.
- Cancellation: You may cancel your membership at any time by providing notice before your next billing date. Cancellation takes effect at the end of the current billing period. No refunds will be issued for the remaining portion of a billing period, except as required by applicable law.
- Price lock: Your membership rate is locked in for as long as your membership remains active and in good standing.
- Missed appointments: Missed appointments or no-shows count as redeemed visits for that billing period.
- Package expiry: Multi-visit packages expire 1 year from the date of purchase. Any unused visits remaining after that date are forfeited.
Gift Cards & Promotional Vouchers
The Cheeky Peach issues two types of gift cards, each governed by its own rules:
- Purchased gift cards are gift cards paid for by a client and intended to be redeemed for our services or products.
- Promotional gift cards and vouchers are cards, vouchers, or certificates issued free of charge as part of an event, giveaway, contest, or marketing promotion.
Standard Gift Card Policy (Purchased Cards)
- Validity & expiry: Purchased gift cards do not expire and may be redeemed at any time for services or products offered by The Cheeky Peach.
- Non-refundable: Gift cards are non-refundable and cannot be redeemed for cash, except where required by law.
- Lost or stolen cards: Treat gift cards like cash. Lost, stolen, or unauthorized use of gift cards will not be replaced or refunded.
- Partial use: Any remaining balance will stay on the card and can be used toward future purchases.
- Transferability: Purchased gift cards are transferable and may be used by any individual presenting the card.
- Practitioner discretion: Acceptance of gift cards is at the discretion of the practitioner and may be declined based on the service booked, scheduling, or other considerations.
Promotional / Event Gift Card Policy (Non-Purchased)
- Promotional value & expiry: Promotional gift cards, vouchers, or certificates issued at events, giveaways, or as part of a promotion are valid until the stated expiration date. These items do expire and will not be honoured past that date.
- No cash value: Promotional cards hold no cash value and cannot be redeemed for cash or credit.
- Cannot be combined: Promotional gift cards cannot be combined with any other offers, promotions, packages, memberships, or discounted services or products.
- One per visit: Only one promotional card may be used per client, per visit.
- Non-transferable: Promotional cards are intended for the original recipient and may not be transferred.
- Limited use: Promotional cards may only be applied toward full-priced services unless otherwise specified.
- Lost or stolen: Lost or stolen promotional cards will not be replaced.
- Practitioner discretion: Acceptance of promotional cards is at the discretion of the practitioner.
Service-Specific Restrictions & Booking
- Service-specific restrictions: Certain promotions or vouchers may be restricted to specific services and cannot be applied toward packages or bundled offers.
- Booking requirement: All gift cards and vouchers must be mentioned at the time of booking and presented at appointment check-in.
General
We reserve the right to modify or refuse redemption of gift cards or promotional vouchers that are suspected of being altered, duplicated, expired, or used in violation of these terms.
Age Requirements
All services are intended for clients aged 18 and over. Clients under the age of 18 may receive select services with written parental or guardian consent and must be accompanied by a parent or guardian during the appointment.
Client Photos & Testimonials
Before-and-after photographs and client testimonials may be displayed on our Site, social media, or within our facility only with the express written consent of the client. You may withdraw your consent at any time by contacting us, and we will remove your images or testimonials within a reasonable timeframe. A separate photo release form is provided prior to any photography.
Intellectual Property
All content published and made available on our Site is the property of Tiffany Currie and The Cheeky Peach. This includes, but is not limited to, images, text, logos, documents, downloadable files, and anything that contributes to the composition of our Site. You may not reproduce, distribute, or use any content from this Site without express written permission.
Limitation of Liability
Tiffany Currie, The Cheeky Peach, and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, or expenses, including legal fees, arising from your use of the Site or from receiving any wellness treatments or services. This limitation applies to the fullest extent permitted by applicable law and does not exclude liability that cannot be excluded under Ontario law.
Indemnity
Except where prohibited by law, by using this Site or receiving our services, you indemnify and hold harmless Tiffany Currie, The Cheeky Peach, and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses, including legal fees, arising out of your use of our Site, your receipt of services, or your violation of these Terms and Conditions.
Consumer Protection Law
Where the Ontario Consumer Protection Act, 2002, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
Dispute Resolution
If you have a concern or dispute regarding our services or these Terms and Conditions, we encourage you to contact us first at [email protected] so we can attempt to resolve the matter informally.
If we are unable to reach a resolution, either party may pursue mediation before initiating legal proceedings. Any legal action shall be brought before the courts of the Province of Ontario, in the Niagara Region.
Payment
Payment for most services is processed through JaneApp at the time of booking or at the time of service. In-person payments may also be accepted at our location. We accept credit card, debit, and other payment methods as indicated at the time of purchase.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Applicable Law
These Terms and Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and services. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.
Privacy Policy
The Cheeky Peach (“we,” “us,” or “our”) is committed to protecting your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.

We collect personal information in the following ways:
Information you provide voluntarily:
- Name, email address, phone number, and message content when you use our contact form
- Information provided when booking appointments through JaneApp
Information collected automatically:
- Cookies, IP address, browser type, device information, and browsing behavior via Google Analytics
- Browser fingerprinting, mouse movements, and interaction data via Google reCAPTCHA Enterprise (used for spam prevention on forms)
Membership data:
- Name, phone number, email address, visit history, service records, and NFC membership card token when you enroll in our membership program
AI chatbot interactions:
- Messages you send through our website chatbot and conversation history during your session
How We Use Your Information
We may use the personal information we collect for the following purposes:
- To communicate with you and respond to your inquiries
- To process transactions, manage bookings, and provide services you request
- To manage your membership, track visits, and administer your account

Google Analytics:

Google reCAPTCHA Enterprise:
We use Google reCAPTCHA Enterprise on our contact forms to prevent spam and abuse. reCAPTCHA may collect hardware and software information, such as device and application data, and send it to Google for analysis. Use of reCAPTCHA is subject to the Google Privacy Policy and Google Terms of Service.
AI Chatbot
Our website features an AI-powered chatbot to help answer your questions about our services, treatments, and booking. The chatbot is not a human — it uses artificial intelligence to generate responses based on information about our business.
Messages you send to the chatbot are processed to generate responses and are not stored beyond your active session. The chatbot is not a medical professional and should not be used for medical advice.
Please do not share sensitive personal health information, payment details, or other confidential data through the chatbot. For private matters, contact us directly.
Third-Party Services
We use the following third-party services that may collect or process your personal information:
- JaneApp: Appointment booking and payment processing. When you book through our Site, you are redirected to JaneApp, which collects your personal and payment information under its own privacy policy.
- Google (Analytics, reCAPTCHA, Reviews): Website analytics, spam prevention, and display of Google Reviews on our Site. Google may collect browsing data as described in the Cookies section above.
- NFC Membership System: Our proprietary membership system stores your membership information, visit history, and service records to manage your account and track your membership benefits.
Disclosure of Personal Information
We may disclose your personal information to third parties in the following circumstances:
- To service providers who assist us in operating our website, processing payments, or providing services to you
- To comply with legal requirements, enforce our Terms and Conditions, or protect our rights, privacy, safety, or property

Data Retention
We retain personal information only as long as necessary to fulfill the purposes for which it was collected:
- Contact form submissions: Up to 2 years from the date of submission
- Membership data: For the duration of your active membership plus 2 years after cancellation
- Analytics data: As configured in Google Analytics (default retention periods apply)
- Chatbot conversations: Not retained beyond your active browsing session
Security
We take reasonable measures to protect your personal information from unauthorized access, use, or disclosure. Our Site uses HTTPS/SSL encryption for all data transmitted between your browser and our servers. Access to personal information is restricted to authorized personnel only. CASL Compliance
In compliance with Canada's Anti-Spam Legislation (CASL):
- We will only send you commercial electronic messages (e.g., newsletters, promotions) with your express consent
- Every commercial message includes a clear and easy unsubscribe mechanism
- Transactional messages (e.g., appointment confirmations, membership notifications) do not require separate consent and may be sent as part of our service delivery
- We maintain records of consent as required by CASL
Children's Privacy
Our Site and services are not directed at children under the age of 13, and we do not knowingly collect personal information from children under 13. Our wellness services are intended for clients aged 18 and over, or minors with parental consent as described in our Terms and Conditions.
Changes to This Privacy Policy
We reserve the right to update or modify this Privacy Policy at any time. When we make material changes, we will update the “Effective Date” below and post a notice on our Site. For significant changes that affect how we use your personal information, we will make reasonable efforts to notify you by email or through a prominent notice on our Site.
